1. Who you're contracting with
The BrandoraFlow service is provided by Julia Aleen Trejo, trading as BrandoraFlow ("BrandoraFlow", "we", "us"). By creating an account or using the service, you enter into a binding agreement with Julia Aleen Trejo.
You confirm that you are of legal age to enter this agreement and, if you use the service on behalf of an organisation, that you have authority to bind that organisation.
2. Acceptance
By creating an account, accessing, or continuing to use BrandoraFlow, you agree to these Terms. If you do not agree, do not use the service.
3. The service
BrandoraFlow provides AI-assisted marketing content, brand-kit management, CRM, invoicing, proposals, calendar/scheduling, and related tools. You are responsible for reviewing generated content before using or publishing it.
4. Acceptable use
You must not misuse the service. In particular, you must not: (a) use the service unlawfully or in violation of third-party rights; (b) send spam, phishing, or fraudulent content; (c) generate misleading, defamatory, deceptive, hateful, or otherwise harmful content; (d) infringe intellectual-property rights; (e) attempt to introduce malware, probe, scan, or breach security; or (f) scrape or automate the service outside of features we provide.
5. Your account
You must provide accurate information and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
6. Intellectual property
The BrandoraFlow platform — including all software, source code, models, prompts, designs, documentation, trademarks, and branding — is owned by Julia Aleen Trejo or her licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the service in accordance with your plan and these Terms.
You retain ownership of the content and materials you upload. As between you and us, you own outputs you generate, subject to the licence you grant us to host and process them in order to provide the service. You must not reverse engineer, resell, or redistribute the service or circumvent its technical limits.
7. Payments, billing, and refunds — Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
All payment, billing, tax, subscription renewal, cancellation, and refund mechanics are governed by the Paddle Checkout Buyer Terms available at https://www.paddle.com/legal/checkout-buyer-terms and the Paddle Refund Policy at https://www.paddle.com/legal/refund-policy. Our Refund Policy summarises how those apply to BrandoraFlow.
8. Service availability & warranty disclaimer
We work to keep BrandoraFlow available and performing well, but we do not guarantee that the service will be uninterrupted, error-free, secure, or that outputs will be accurate, complete, or fit for any particular purpose.
To the maximum extent permitted by law, the service is provided "as is" and "as available" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or related to the service in any 12-month period is limited to the fees you paid to us during that period. We are not liable for indirect, consequential, incidental, special, or exemplary damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law (such as fraud, death, or personal injury caused by negligence).
10. Suspension and termination
We may suspend or terminate your access to the service for: (a) material breach of these Terms; (b) non-payment; (c) suspected fraud, security risk, or abuse; or (d) repeated or serious policy violations. You may cancel your subscription at any time from the billing portal.
On termination, your right to use the service ends. We may delete your data after a reasonable export period, subject to legal retention obligations.
11. AI-generated content
BrandoraFlow uses AI models to help generate content. Outputs may be inaccurate, biased, or unsuitable, and are not professional advice. You are responsible for your prompts, for verifying and editing outputs before use, and for ensuring you have the rights to any content you input. We may filter, refuse, or remove content that violates these Terms.
12. Changes
We may update these Terms. Material changes will be announced in-app or by email. Continued use of the service after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Julia Aleen Trejo is established, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory law provides otherwise.
